Between 21 and 28 July 2022, Latvia, Lithuania, and New Zealand have sought to intervene before the International Court of Justice in Allegations of Genocide under the Convention on the Prevention and Punishment of the Crime of Genocide (Ukraine v. Russian Federation), leading a potential avalanche of interventions in this ongoing case.  During the same week, the Court determined its jurisdiction in another Genocide Convention case, The Gambia v. Myanmar, in which other states have already indicated their intent to intervene.  In this timely ESIL-supported webinar, academics and practitioners discussed the challenges and possibilities which these developments reveal for the Court, interested States, and the international community.

This webinar contextualized these challenges and possibilities by drawing from Dr. Brian McGarry’s forthcoming Cambridge University Press monograph, Intervening in International Justice: Third States before Courts and Tribunals, which places intervention at the centre of some of the most beguiling questions in international dispute settlement.  As jurists and scholars have often addressed these questions in isolation, each development in third-State practice has raised unimagined issues of first impression.  By applying conceptual, comparative, and historical approaches to international justice, this new book instead offers a uniquely holistic assessment of the practice and prospective development of intervention.
